Understanding Colorado Regulation 28
Colorado’s Regulation 28, adopted in 2023, establishes statewide Building Performance Standards (BPS) for large commercial, multifamily, and public buildings. The goal: reduce greenhouse gas emissions from the building sector in alignment with Colorado’s climate goals.

Buildings 25,000 square feet and larger are required to benchmark energy usage and meet performance targets — or face potential penalties.

Key Compliance Timelines:

October 1, 2023: Regulation goes into effect

December 1, 2023: First benchmarking report due

2026: First performance target must be met (7% energy use reduction baseline)

2030: Second target deadline (20% total reduction from baseline)

2035: Final phase of current performance targets
